Dalam al-Quran, konsep halal dan haram merupakan prinsip asas syariah yang bertujuan menjaga maslahat manusia serta memelihara agama, nyawa, akal, keturunan dan harta; Allāh SWT dengan jelas menghalalkan perkara yang baik (ṭayyibāt) dan mengharamkan perkara yang buruk (khabā’ith). Masyarakat Bajau memang terkenal dengan karakteristik Bajau di samping lain-lain keunikan budaya yang membentuk identiti khas iaitu makanan laut yang unik. Salah satu aspek penting adalah mengenai pemakanan orang Bajau yang memasak dan memakan sesetengah ikan bersama najisnya, sotong bersama dakwatnya serta ketam yang hidup dua alam. Kajian ini merupakan kajian kualitatif kaedah kepustakaan berdasarkan ayat al-Quran, hadith dan pandangan ulama dalam perbahasan fiqh. Kaedah pemerhatian ikut serta dan beberapa temubual juga dijalankan bersama beberapa pengamal adat resam Bajau Ubian untuk memastikan objek kajian yang tepat. Melalui pendekatan induktif dan deduktif, kajian ini menganalisis ayat al-Quran, hadith dan pandangan ulama dengan lebih jelas sudut pandang hukum Islam terhadap ketiga-tiga isu tersebut. Hasil kajian ini mendapati pemakanan orang Bajau khasnya Bajau Ubian dibolehkan berdasarkan keluasan pandangan fiqh muktabar. Hal ini sekaligus memberi jawapan kepada permasalahan mengenainya serta membuktikan bahawa syariah Islam tidak menghapuskan identiti dan budaya sesebuah bangsa atau kaum, namun meraikannya sesuai dengan garis panduan hukum Islam.

In the Holy Quran, the concept of halal and haram is a principle of syari’ah which aims to safeguard human benefits and preserve the fundamental objectives; faith, life, intellect, lineage and wealth. Allah SWT clearly permits good things (ṭayyibāt) and forbids bad things (khabā'ith). The Bajau societies are surely famous for their characteristics, besides other cultural uniqueness that form a distinctive identity, namely uniques seafoods. One of the important aspects is about the food of the Bajau society who cook and eat some fish with their excrement, cuttlefish, squid and octopus with their ink and crabs which live in two worlds; land and sea. This study is a qualitative study, literature methods based on verses from the Holy Quran, hadīth and the opinions of fiqh scholars. A method of observation was involved and several interviews were also carried out with several Bajau Ubian cultural practitioners to make sure the appropriate object of this study. Based on an inductive and deductive approach, this study analyzes verses from the Holy Quran, hadīth Nabawī and the opinions of ulama according to these three issues. The results of this study conclude that the Bajau seafood, specifically Bajau Ubian, is permissible based on the broad perspective of muktabar fiqh. This also provides answers to problems regarding it and proves that Islamic syarī’ah does not nullify the identity and culture of a nation or people. In fact Islam is tolerant in accordance with the guidelines of Islamic law.
